The final blue candy

Okay, gang. Let’s make this last posting on blue candy. I think we’ve reached the limit.

To Cindy at the University of Montana, No, Nestle’s blue Smarties candy is not the focus of the suit by the Naked Cowboy. It’s a blue M&M.

The “cowboy,” Robert Burck, has filed a lawsuit against the Mars Candy Co. and its advertising agency in Manhattan Federal Court for $6 million.

The 37-year-old Burck has been thrilling, shocking, okay, amusing, tourists in New York’s Times Square for more than a decade as he walks the streets, playing his his white guitar and wearing only a cowboy hat, white boots and white briefs.

Burck, the strolling photo opportunity, has sued the candy maker because towering over the turf where the cowboy roams are two, very large, animated billboards showing a bouncing, scantily clad blue M&M with a white guitar and cowboy hat.

Burck said the M&M’s advertisement infringes on his trademark, as it were.
